Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the https://Stellar DataStore website and its software (the "Service") operated and provided by tmssoftware.com bvba. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Acceptable Conduct

You are responsible for the actions of all users of your account and any data that is created, stored, displayed by, or transmitted by your account while using Stellar DataStore or its software. You will not engage in any activity that interferes with or disrupts Stellar DataStore's services or software. You will not use the Stellar DataStore service or software for actions illegal in your country of residence.

Support Boundaries

Stellar DataStore, provides 24 x 7 technical support to customers having purchased a license or subscription to any Stellar DataStore service or software product. The following are our guidelines when providing support: Stellar DataStore provides support related to the Stellar DataStore service and software. Stellar DataStore does not offer technical support for issues not directly related to its software or service, including support for network setup or third party software such as, but not limited to firewall, proxy, anti-virus that might interfere with the operation of the Stellar DataStore service or software. Stellar DataStore is not obliged to provide technical support to users who did not purchase a license or subscription but tries to help evaluating users where possible.

Termination

Stellar DataStore may terminate or suspend access to our Service or software immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Security

Stellar DataStore is dedicated to keeping your information secure, safe and private. While no service is completely secure, Stellar DataStore takes all reasonable measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction.

Retention

Stellar DataStore retains information you store on our Services for as long as we need it to provide you the Services. If you delete your account, we'll also delete this information.

Limitation of Liability

Customer acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of Stellar DataStore and that damages resulting from any interruption of service are difficult to ascertain. Therefore, customer agrees that Stellar DataStore shall not be liable for any damages arising from such causes beyond the direct and exclusive control of Stellar DataStore. Customer further acknowledges that Stellar DataStore's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by the customer for services during the period damages occurred. In no event shall Stellar DataStore be liable for any special or consequential damages, loss or injury. Stellar DataStore is not responsible for any damages your business may suffer. Stellar DataStore does not make implied or written warranties for any of our services. Stellar DataStore denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Stellar DataStore.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
